Terms and Conditions

1. General Provisions

1.1. These terms and conditions of purchase and sale (hereinafter referred to as the "Terms") establish the mutual rights, obligations, and responsibilities of the person purchasing goods in the online store www.mimosbabycare.com (hereinafter referred to as the "Online Store") as the buyer (hereinafter referred to as the "Buyer") and MB HE Vector, company code 305544642, as the seller (hereinafter referred to as the "Seller").

1.2. By purchasing goods in the Online Store, the Buyer agrees to these Terms.

2. Conclusion of the Purchase-Sale Agreement

2.1. The purchase-sale agreement (hereinafter referred to as the "Agreement") between the Buyer and the Seller is deemed concluded from the moment the Buyer selects goods in the Online Store, provides their name, surname, phone number and delivery address, selects the payment and delivery method, agrees to these Terms, and clicks the "Confirm Order" button. The Agreement remains in force until all obligations under it are fully fulfilled.

2.2. If the Buyer does not agree with any of the provisions of these Terms, they must not place an order.

2.3. Each Agreement concluded between the Buyer and the Seller is stored in the Seller's database.

2.4. By placing an order, the Buyer agrees to receive information related to order fulfillment and delivery via the email address provided at the time of purchase.

3. Buyer's Rights and Obligations

3.1. The Buyer must pay for the goods and their delivery and accept the ordered goods.

3.2. If due to an error or technical issues, payment was not made at the time of order placement or delivery, but the goods were delivered, the Buyer must immediately notify the Seller and pay for the purchased goods within three (3) business days.

3.3. If the information provided in the order form changes, the Buyer must immediately inform the Seller.

4. Seller's Rights and Obligations

4.1. The Seller undertakes to provide all necessary conditions for the Buyer to use the Online Store services properly and to deliver the ordered goods as specified by the Buyer.

4.2. In important circumstances, the Seller may temporarily or permanently discontinue the Online Store's operation without prior notice.

4.3. The Seller reserves the right to amend, modify, or supplement the Terms at any time in accordance with applicable legal requirements. The Buyer will be informed of such changes on the Online Store's website. The Terms valid at the time of order placement apply to each purchase.

4.4. The Seller has the right to cancel the Agreement if the ordered goods are out of stock.

5. Delivery of Goods

5.1. The goods are delivered by an authorized representative of the Seller (a courier service) according to the delivery method selected by the Buyer at the time of order placement. Delivery costs are borne by the Buyer, except in cases specified by the Seller.

5.2. Shipping costs and delivery times depend on the destination country.

5.3. For international deliveries, the Seller undertakes to deliver in-stock goods within thirty (30) calendar days from receipt of payment. If the ordered goods are unavailable at the time of Agreement conclusion and the Buyer does not agree to a longer delivery term, the Seller will cancel the Agreement and refund the amount paid within three (3) business days.

5.4. If the Buyer chooses delivery to a parcel terminal, they must collect the package within the time specified by the courier. If the Buyer fails to collect the goods within the specified period, the goods are returned to the Seller, and it is deemed that the Buyer has canceled the Agreement.

5.5. If the Buyer selects personal delivery, they must inspect the package for visible damage together with the Seller or the Seller’s representative upon receipt.

5.6. By signing the delivery note or acceptance document, the Buyer acknowledges receipt of the goods.

5.7. If the Buyer notices damage to the package, they must note this in the delivery document. If the Buyer signs the document without comments, it is assumed that they have no complaints about the product’s quality.

6. Returns

6.1. Returns and exchanges are conducted in accordance with Lithuanian legislation, including Government Resolution No. 738 of July 22, 2014, and the Civil Code articles 6.22810 and 6.22811.

6.2. The Buyer has the right to return a purchased item within fourteen (14) days by notifying the Seller in writing or by email.

6.3. The returned item must be in its original packaging and complete.

6.4. The item must be in its original, undamaged condition, without signs of use or cleaning. If packaging or labels are removed, the Seller may refuse the return.

6.5. If packaging damage prevents the item from being resold at full price, the return may only be accepted if the Buyer agrees to compensate for depreciation.

6.6. When returning an item, the Buyer must provide a written request, including order details and a refund account number.

6.7. If a discount was applied at the time of purchase and only part of the order is returned, the Seller may deduct the discount from the refund amount.

6.8. The Buyer bears return shipping costs unless the return is due to the Seller’s error or defective goods.

6.9. A 14-day warranty applies to all goods sold in the Online Store.

6.10. If defects arise within the warranty period, the Buyer may return the product for repair, replacement, or a refund.

6.11. The Buyer must use the product in accordance with the manufacturer's instructions.

7. Liability

7.1. The Seller is responsible for product quality, accurate order fulfillment, and timely delivery.

7.2. The Buyer is responsible for the accuracy of the information provided.

7.3. If incorrect information is provided, the Seller is not liable for delays or losses.

7.4. The Buyer is responsible for actions taken in the Online Store.

7.5. The Seller is not responsible for third-party website content, even if linked from the Online Store.

7.6. If either party causes damage due to non-compliance with the Agreement, they must compensate for the losses incurred.

8. Final Provisions

8.1. The Seller will send notifications to the Buyer's registered email address.
